- Product Sample
- According to this Agreement, the Product sample is recognized as a photographic image of the corresponding Product posted in the Shop on the Product description page.
- Order and Payment of the Order
- The Order in the Shop is formed by the Customer online.
- The Customer can track the Order Status in the "My Orders" section located in the Customer Account.
- An Order for which payment has been received before 15:00 on business days is processed and transferred to the Delivery Service on the same business day.
- An Order for which payment has been received after 15:00, as well as on weekends and holidays, is processed and transferred to the Delivery Service on the next business day.
- An Order for which payment has not been received within 7 (seven) calendar days is canceled.
- Customer Data and Confidentiality
- The Customer undertakes to provide correct data during registration and placing an Order:
- name
- surname
- contact phone number, including city code if necessary
- email address
- postal address for Product delivery, including postal code
- The Customer is solely responsible for problems related to the delivery of Orders due to incorrect data provided by the Customer.
- The Shop does not transfer the Customer's personal data to third parties without the Customer's consent, except as provided by the legislation of the European Union, as well as related to the direct fulfillment of the Order.
- The Shop reserves the right to use Cookie files, which are used for the convenience of users and to improve the functionality of the site.
- Customer's Refusal of the Product within 14 days
- The Customer has the right to refuse the received Product within 14 (fourteen) calendar days after receiving the Product without stating reasons. To refuse the received Product, the Customer must notify the Shop within 14 (fourteen) calendar days from the moment of receiving the Product through the Feedback Form.
- The Shop returns the amounts paid for the Product (including postal expenses related to the shipment of the Product to the Customer) to the Customer's current account (the account from which the Customer made payment for the Product) no later than within 30 (thirty) calendar days from the date of receipt by the Shop of the notice of refusal of the received Product.
- All expenses related to the return of the Product, within the amount equal to 10 (ten) Euros, are borne by the Customer.
- The Customer is obliged to return the Product to the Shop by mail to the Shop's Postal Address within 30 (thirty) calendar days from the moment of notification.
- The Customer does not have the right to refuse the received Product, and the Product is not subject to return if the Product ordered by the Customer was made taking into account the Customer's personal needs and/or in accordance with the conditions presented by the Customer.
- The returned Product must be unused, in its original packaging and with all original markings.
- Shop's Refusal to Fulfill the Order
- The Shop has the right, without any sanctions, to withdraw from the obligation to fulfill the Customer's Order in the following cases:
- the Product ordered by the Customer is out of stock
- the Customer does not fulfill the conditions described in paragraph "1." of section "VIII. Responsibility"
- If the Shop cannot fulfill the Order, the Shop notifies the Customer about this.
- The Shop has the right to offer the Customer an alternative Product to the one ordered by the Customer.
- If the Customer does not agree to an alternative Product to the one ordered by the Customer, but the Customer has already made payment for the Order, the Shop returns to the Customer all amounts paid for the Product, including the cost of Product delivery, to the Customer's current account (the account from which the Customer made payment for the Product) no later than within 14 (fourteen) calendar days from the moment the Shop learned about the impossibility of fulfilling the Order.
- Right to Make a Claim
- If the Product sent to the Customer does not correspond to the Product ordered by the Customer, or has defects, the Customer has the right to make a claim to the Shop, the deadline for submitting a claim is 2 (two) years from the date of receipt of the Product.
- Procedure for making a claim:
- The Customer notifies the Shop of the circumstances described in paragraph "1." of this section no later than before the expiration of the deadline for submitting a claim.
If in certain cases the legislation of the European Union provides for later deadlines for making claims, then, in these cases, the Customer has the right to make a claim to the Shop also at later deadlines, according to the deadlines and procedures provided for by the legislation of the European Union;
- The Customer returns the Product to the Shop, while the date of sending the Product must be no later than the 30th (thirtieth) calendar day from the date of making the claim;
- The Shop performs free repair of the Product;
- If repair of the Product is not possible, the Shop replaces the Product;
- If repair and replacement of the Product are not possible, or are unsuccessful, the Shop returns to the Customer all amounts paid for the Product;
- The Shop bears all postal costs for sending the Product, including the cost of Product delivery and the Customer's postal costs for returning the Product in connection with repair, replacement or final return of the Product;
- All amounts to be returned by the Shop to the Customer are paid to the Customer's current account no later than within 14 (fourteen) calendar days from the date of receipt by the Shop of the Product returned by the Customer, provided that the Customer complies with all conditions for returning the Product.
- The Shop is not responsible for and does not bear additional costs for Product defects that arose as a result of improper use or maintenance, as well as Product damage by the Customer.
- Return of the Product for repair or replacement, as well as for final return, is made by the Customer to the Shop by sending through a Delivery Service pre-agreed with the Customer to the Shop's Postal Address.
- Product Delivery and Delivery Services
- Product delivery is carried out through and on the terms of Delivery Services selected by the Customer when placing an Order.
- The Shop is not responsible for the operation and quality of Delivery Services.
- The Shop uses all available Shop warehouses for the prompt fulfillment of the Customer's Order.
- Sending the Product for repair, replacement or return always takes place to the Shop's Postal Address, regardless of the warehouse from which the Product was sent.
- Responsibility
- By performing any actions in the Shop, the Customer thereby confirms that:
- he is a legally capable, independent and adult individual or he is a legal entity and his representative has all rights to use the Shop on behalf of this legal entity;
- he fulfills all conditions of using the Shop;
- The Shop's responsibility in any case is limited to the amount of the Customer's order.
- Sales, shipping and invoicing in the Shop are carried out by the company: Ellexa Group OÜ, Reg. nr.: 14322121, Paldiski mnt. 157-48, 13518 Tallinn, Estonia. This address is also the Shop's Postal Address for sending returns.
- In matters not regulated by this Agreement, the Shop and the Customer are guided by the legislation of the Republic of Estonia.
- Disagreements arising from this Agreement are resolved in the manner established by the legislation of the Republic of Estonia.
- The Shop reserves the right to unilaterally change or supplement this Agreement and/or Product prices by publishing an amended version of this Agreement and/or Product prices in the Shop without prior notice.
- This Agreement and/or Product prices are valid from the moment of publication until the publication of an amended version of this Agreement and/or Product prices in the Shop.
- If the Order is placed by the Customer before the entry into force of the amended version of this Agreement in the Shop, the version of this Agreement and/or Product prices in the Shop valid at the time of completing the Order placement applies to this Order.
- Without the written consent of the Shop, full or partial use of materials located on the Shop's website is prohibited.
